Linking Disclaimers for Private Investigators
Private Investigators and Security Consultants of maturity have belonged to Professional organisations for many years and personally I have used the web for marketing and have had links to various organisations. Occasionally and for various reasons we leave these organisations and on parting company we leave a trail of links on the internet that are virtually impossible to remove. That is when problems can occur especially if you have had conflicts of interest or other issues with the professional organisations. It is therefore advisable to use a Disclaimer on your website. If any member has any disclaimers in mind then lets pool our thoughts together. It is good that the Council of International Investigators does not show any affiliates on their web site http://www.cii2.org/
To minimize liability for any activities that occur when a visitor is taken to a linked website, a webmaster may want to include a disclaimer on the home page. A disclaimer is a statement denying an endorsement or waiving liability for a potentially unauthorized activity. Please note that the Directors of Portsea International formerly Anglo French Research are not members of or affiliated to The Association of British Investigators and should anybody find any links to this organisation please contact us at email@example.com and we will endeavour to remove them from the offending site.
A disclaimer is not a cure-all for infringement, but if a disclaimer is prominently displayed and clearly written a court may take it into consideration as a factor limiting damages (see Chapter 12, “Releases”). For example, in a case involving a dispute between websites for two restaurants, both named Blue Note, one factor that helped the lesser-known restaurant avoid liability was a prominently displayed disclaimer stating that it was not affiliated with the more famous restaurant. (Benusan Restaurant v. King, 937 F. Supp. 295 (S.D. N.Y. 1996)
